Rules and Forms

Superior Court of Justice rules and forms govern Superior Court proceedings across Ontario. Each of the following areas of the Court have their own specific rules and forms.

Civil

Rules of Civil Procedure Civil proceedings in the Superior Court are governed by the Rules of Civil Procedure unless otherwise stated.
Rules of Civil Procedure Forms The Rules of Civil Procedure require the use of a set of prescribed forms for civil proceedings.

Criminal

Divisional Court

Rules of Civil Procedure Civil proceedings in the Superior Court are governed by the Rules of Civil Procedure unless otherwise stated.
Family Law Rules Certain appeals in family proceedings to the Divisional Court are governed by the Family Law Rules.

Family

Family Law Rules Family proceedings in the Superior Court are governed by the Family Law Rules unless otherwise stated.
Family Law Rules Forms The Family Law Rules require the use of a set of prescribed forms for family proceedings.
Trial Scheduling Endorsement Form: The new trial scheduling endorsement form will be required before a trial date is provided in a family case. Litigants will be asked to complete Parts 1 and 2 of the form for or immediately after the settlement conference. Part 3 of the form will be completed by the judge after the issues have been reviewed with the parties.
Trial Scheduling Endorsement Form – Child Protection: The new child protection scheduling endorsement form is available for a child protection case.
Motion to Change Endorsement Form: This form can be used as a draft endorsement to obtain direction regarding the process for these cases.
Family Responsibility Office Forms : The Ministry of Community and Social Services provides additional family law forms that are required in certain circumstances according to government policies and legislation.

Small Claims Court

Rules of the Small Claims Court: Small Claims Court proceedings in the Superior Court are governed by the Rules of the Small Claims Court unless otherwise stated.

Publication Ban Forms

Notice of Request for Publication Ban:This form is prescribed under section (F) of Part V of the Court’s Consolidated Provincial Practice Direction.
Request to be added to Superior Court of Justice Publication Ban Notification Media Subscriber List : This form is prescribed under section (F) of Part V of the Court’s Consolidated Provincial Practice Direction.
