Part Three: Hearing of the Application for Leave to Appeal
When will the application for leave to appeal be listed for hearing?
Within 30 days after the filing of the materials related to the leave application, the materials shall be forwarded to a panel of the Court of Appeal assigned to hear criminal appeals during the week the materials are forwarded.
How is the decision made and when are the parties notified of the decision?
The panel will decide whether to grant or refuse leave to appeal based on the written materials and without the attendance of the parties.
The court will notify the parties of the decision granting or refusing leave to appeal. The panel will generally not provide reasons for granting or refusing leave to appeal.
If the court refuses the application for leave to appeal, the file will be closed.
